How likely is it that I have a Nightingale visiting my garden?

I live in Plymouth, Devon and I see this bird on a daily basis. I have used bird identifiers and the only bird it could be is a Nightingale, however being January is this not a little strange?

Here in Scotland a nightingale would be out of the question. We have plenty of robins that sing like nightingales both day and night often at this time of year. 
What else could your bird be?---- a dartford warbler, what do they look like??
